These terms cover your use of Wish List Project (“Wish List”), at wishlistproject.com, a service for making wish lists and sharing them with friends and family. Our texts and emails come from “Wish List”. Wish List Project is run by Jason Lynn (“we”, “us”) as a free personal project: we don’t charge for it. By using Wish List, you agree to these terms and to our Privacy Policy, which explains how we handle your information.

Please read the “Disclaimers, release and limit of liability” section carefully. It includes a waiver of claims against us, including claims for our own negligence.

Who can use Wish List

You must be 18 or older to create or use an account. Before you use your account, we ask you to confirm your age and accept these terms, and we record when you did. If you open an invite or a shared list, you agree to these terms for that use.

Your account

You sign in with one-time links we send to your email address or mobile number. Keep access to that email account and phone secure, because anyone who can open the link can sign in as you. You’re responsible for what happens in your account. If you think someone else has signed in, use Sign out everywhere on your account page and contact us.

Your lists and the people you invite

  • You’re responsible for what you put on your lists, including item names, links and comments.
  • Only add people you know and who would expect to hear from you. You must have their permission to give us their name, email address or mobile number.
  • We never text a mobile number that someone else gave us. Invites and thank-you notes go by email. For a contact with only a mobile number, you copy their personal link and send it yourself.
  • Anyone who has a share link or invite link can use it. Invite links are personal, and actions taken through one are recorded under that invitee’s name.

Acceptable use

Don’t use Wish List to:

  • send spam or messages people didn’t ask for, or invite people you don’t know;
  • harass, threaten or impersonate anyone;
  • post anything illegal, or links to malware or scams;
  • get around rate limits, bot protection or other security measures, or try to reach data that isn’t yours;
  • scrape or overload the service.

We may remove content, stop sending messages for, or suspend accounts that break these rules.

Text messages (SMS)

  • Program: Wish List Project account and list notifications. Texts start with “Wish List:”.
  • What we send: sign-in links, links to confirm a mobile number, links to edit your lists, reminders before a list expires, messages about your own lists such as a question about an item, and confirmations for items you text in to your account. We only text the account holder who opted in, never people they invite.
  • How you opt in: by ticking the SMS consent box when you enter your mobile number to sign in or create an account, or when you add it on your account page. The box is never ticked for you, and texts are optional: you can use Wish List by email instead.
  • Frequency: message frequency varies with how you use Wish List.
  • Cost: message and data rates may apply.
  • Opt out: reply STOP to any message. We’ll confirm, and send no more texts to that number.
  • Help: reply HELP, or email support@wishlistproject.com.
  • Carriers aren’t liable for delayed or undelivered messages.
  • We don’t sell or share mobile numbers or text-message opt-in data with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Links to other sites

Items on lists link to other websites, such as stores. We don’t sell those products and aren’t responsible for those sites, their prices or their availability.

Ending your use

You can stop using Wish List at any time, and delete your lists in the app. To close your account and delete its data, email us.

We may change, suspend or shut down Wish List, or any part of it, and we may suspend or delete any account, list or content, at any time, for any reason, with or without notice.

Changes

We may change these terms. If a change materially affects you, we’ll tell account holders by email or text before it takes effect, and ask you to accept the new terms the next time you use your account. Continuing to use Wish List after a change takes effect means you accept the new terms.

Disclaimers, release and limit of liability

No warranties. WISH LIST IS PROVIDED FREE OF CHARGE, “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. WE DON’T PROMISE THAT WISH LIST WILL BE AVAILABLE, SECURE OR ERROR-FREE, THAT MESSAGES WILL BE DELIVERED, OR THAT ANY INFORMATION ON IT IS ACCURATE.

Your data. We have no duty to back up, keep or recover your lists, contacts or any other content. Keep your own copy of anything that matters to you.

Release, including for our negligence. YOU USE WISH LIST AT YOUR OWN RISK. TO THE FULLEST EXTENT THE LAW ALLOWS, YOU RELEASE JASON LYNN AND ANYONE WHO HELPS RUN WISH LIST FROM ALL CLAIMS, DEMANDS AND LIABILITY OF ANY KIND ARISING FROM OR RELATED TO WISH LIST OR THESE TERMS, INCLUDING CLAIMS ARISING FROM OUR OWN NEGLIGENCE. THIS INCLUDES, FOR EXAMPLE, LOST OR DISCLOSED DATA, MESSAGES SENT, DELAYED OR NOT SENT, OUTAGES, AND GIFTS BOUGHT, MISSED OR DUPLICATED.

Limit of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO WISH LIST IS FIVE DOLLARS ($5).

Nothing in these terms limits liability for gross negligence, intentional wrongdoing, or anything else the law doesn’t allow to be limited. If any part of this section can’t be enforced, the rest still applies to the fullest extent the law allows.

Account sharing and minors

  • You must be 18 or older to use a Wish List account.
  • Don’t share your sign-in links, or access to the email account or device you sign in with, with anyone under 18.
  • If you let anyone under 18 use your account, you take full responsibility for that use, and you agree to indemnify and hold us harmless from any claims, losses or costs, including reasonable legal fees, arising from it.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about these terms or Wish List will be handled in the state or federal courts located in New York, unless the law where you live requires otherwise.
